Terms and Conditions of Use – Letraria

1. Presentation

LETRARIA is a digital platform aimed at connecting professionals in the literary, editorial, linguistic and related fields (hereinafter, "Professionals") with individuals or legal entities requiring their services (hereinafter, "Clients"), facilitating interaction between both parties for the contracting of services related to writing, proofreading, translation, editing, literary consulting and other related activities.

This document constitutes the General Terms and Conditions of Use (hereinafter, the "Terms and Conditions") that govern access, navigation, use and, where applicable, contracting of services offered through the LETRARIA platform, as well as the rights and obligations derived from the relationships established between users, whether Professionals or Clients.

Access and/or use of the platform, as well as registration as a user, implies reading, understanding and full, express and unreserved acceptance by the user of the entire content of these Terms and Conditions, as well as any other complementary policy or regulation that is duly published and in force on the platform at the time of use.

The User declares to have the necessary legal capacity to contract and be bound by the terms provided in this document, assuming the commitment to use the platform in accordance with current legality, good faith, public order and digital coexistence standards.

2. Letraria Bookstore

Letraria Bookstore is the main platform of LETRARIA, designed to connect independent authors with readers, facilitating the publication, distribution and sale of books in both digital and physical formats.

2.1. How Letraria Bookstore Works

Letraria Bookstore operates as a specialized book marketplace, where:

  • Authors (Professionals): Can publish their books, set prices, manage their sales and receive payments directly for each purchase made.
  • Readers (Clients): Can explore, purchase and download digital books or receive physical books, with immediate access after purchase.

2.2. Book Publication

Authors registered as Professionals can publish their books on the platform, providing:

  • Book information (title, description, category, language, number of pages, ISBN if applicable).
  • Book files (digital format: PDF, EPUB, MOBI, etc.).
  • Book cover (high-quality image).
  • Sale price and book type (digital, physical, or both).
  • Excerpt or first chapter (optional, so readers can preview the content).

Published books are subject to review and approval by LETRARIA before being visible on the platform, ensuring content quality and suitability.

2.3. Book Purchase

The purchase process in Letraria Bookstore works as follows:

  • Digital Books: The reader pays the price set by the author and receives immediate access to download the digital file of the book.
  • Physical Books: The reader pays the set price and provides their shipping address. The book will be sent to the indicated address.
  • Digital and Physical Books: The reader receives immediate access to the digital format and, in addition, the physical book will be sent to their address.

Payments are processed immediately through Stripe, without an escrow system, as books are products delivered instantly (digital) or through physical shipping.

2.4. Commissions and Expenses in Letraria Bookstore

The following economic conditions apply in Letraria Bookstore:

  • Letraria Commission: A commission is applied on the book's sale price, which varies depending on whether the author is a Letraria Inside user (20%) or an external author (30%). This commission can be customized by the administrator for specific cases.
  • Printing and/or Shipping Expenses: For physical books, printing and shipping expenses are deducted from the payment to the author. These expenses are not added to the price paid by the reader, but are deducted from the author's income along with Letraria's commission.
  • Payment to Author: The author receives the book's sale price, minus Letraria's commission and minus printing/shipping expenses (if applicable).

Example: If a book costs 25 EUR, has a 10% commission (2.50 EUR) and printing/shipping expenses of 10 EUR, the author will receive 12.50 EUR (25 - 2.50 - 10 = 12.50). The reader pays only the 25 EUR book price.

2.5. Book Management by Administrator

LETRARIA, through its administration panel, manages all books published on the platform, being able to:

  • Publish or unpublish books.
  • Set or modify the Letraria commission applicable to each book.
  • Set or modify printing and/or shipping expenses for physical books.

These settings apply to all future purchases of the book, allowing adjustment of economic conditions according to market needs or specific agreements with authors.

2.6. Reviews and Ratings

Readers who have purchased a book can leave a review and rating (1 to 5 stars) about it. These reviews help other readers make informed decisions and contribute to the overall quality of the platform.

Reviews must be truthful, respectful and based on real reading experience. LETRARIA reserves the right to moderate or remove reviews that do not meet these criteria.

3. Platform Owner and Responsible Party

In compliance with current regulations on information society services and electronic commerce, as well as in compliance with the duty of information provided in Article 10 of Law 34/2002, of July 11, on information society services and electronic commerce (LSSI-CE), users are informed that the ownership of the digital platform LETRARIA corresponds to:

4. Registration and User Profiles

Access to services offered through the LETRARIA platform requires prior user registration by completing the form enabled for this purpose on the website, thus creating a personal account that will allow them to operate as a Client or Professional, as appropriate.

The user undertakes to provide truthful, complete and updated information during the registration process, as well as to keep such information updated at all times. Omission or falsity in the data provided may result in account suspension or cancellation, without prejudice to any legal actions that may correspond.

4.1. General User Obligations

Every user registered on LETRARIA assumes the following basic obligations:

  • Verify their email address to validate their account.
  • Keep contact and public profile data updated.
  • Indicate their legal status accurately, selecting one of the following options:
    • Individual person.
    • Self-employed professional.
    • Company or legal entity.

4.2. Available Profiles

The platform distinguishes between two types of users, with differentiated functionalities:

  • Client: registered user whose purpose is to contract services offered by Professionals.
  • Professional: registered user who offers their services within the specialization areas covered by the platform.

4.3. Specific Obligations of the Professional Profile

Users registered as Professionals must comply with the following additional conditions:

  • Complete their profile with truthful data about their identity, professional background, experience and areas of specialization.
  • Accredit their identity with a valid official document (ID card, NIE or passport).
  • Comply with their tax obligations in accordance with applicable regulations in their country of residence, ensuring they are legally able to issue invoices and receive payments.
  • Publish only services aligned with the nature of the platform, that is, activities related to letters, writing, editing, proofreading, translation, production of literary or editorial content and other related branches. If services that deviate from these criteria are detected, LETRARIA reserves the right to suspend or remove such service or, where applicable, the complete professional profile.
  • Configure their payment account through the payment system enabled by the platform, mainly through Stripe Connect, expressly accepting its terms of use and completing the required verification procedure. If this payment system is not compatible with the Professional's location or tax situation, they must contact LETRARIA to establish a secure and traceable alternative that meets the guarantees required by current regulations.

4.4. User Tax Responsibility

The User, and in particular the Professional, assumes exclusively and unconditionally the responsibility to comply with all their tax, fiscal and legal obligations derived from their activity on the platform, including, without limitation:

  • Registration in the corresponding tax regime (Special Regime for Self-Employed Workers, registration with the Tax Authority, etc.) when legally required.
  • Issuance of invoices or valid tax documents in accordance with applicable regulations in their jurisdiction.
  • Declaration and payment of taxes, fees and contributions corresponding to income obtained through the platform.
  • Compliance with information and tax reporting obligations that may be required by competent authorities.
  • Obtaining and maintaining the necessary authorizations, licenses or permits for the exercise of their professional activity.

LETRARIA acts exclusively as a technological intermediary that facilitates the connection between Clients and Professionals, as well as payment management and invoice issuance for its own intermediation commissions. In no case does LETRARIA assume any responsibility for:

  • Non-compliance by the User with their tax, fiscal or legal obligations.
  • Sanctions, fines, surcharges or responsibilities of any nature that may arise from the User's tax non-compliance.
  • Verification of the User's tax, fiscal or legal situation, beyond the collection of data voluntarily provided by them.
  • Consequences derived from the issuance of incorrect, incomplete or non-compliant invoices by the Professional.

The User indemnifies and holds LETRARIA harmless against any claim, sanction, fine, expense or liability that may arise from non-compliance with their tax, fiscal or legal obligations, including costs and legal expenses that LETRARIA may incur in defense of its interests.

LETRARIA reserves the right to suspend or cancel the account of any User who fails to comply with their tax or legal obligations, or who provides false or incomplete information about their tax situation, without prejudice to any legal actions that may correspond.

The User expressly authorizes LETRARIA to communicate their tax and transaction data to competent authorities when required by applicable regulations (including, without limitation, obligations derived from Directive DAC7 or equivalent regulations).

4.5. Account Security

The user will be solely responsible for the custody and confidentiality of their access credentials (username and password), committing not to transfer them or allow their use by third parties. Likewise, they will be responsible for all activities carried out from their account, exonerating LETRARIA from any liability derived from unauthorized use.

LETRARIA reserves the right to temporarily suspend or permanently delete those accounts that contain false, incomplete information, or whose activity shows fraudulent use or contrary to good faith and these Terms and Conditions.

4.6. Prevention of Professional Intrusion and Unfair Competition

The measures described in these Terms and Conditions, including the requirements for access to the professional profile, the obligation to provide accrediting documentation, the requirement for work samples, the internal minimum price policy and the powers of suspension or cancellation of accounts, are intended to preserve a professional work environment, avoid intrusion and prevent unfair competition practices within the platform.

In this regard, LETRARIA may:

  • a) Establish and update minimum access and permanence criteria as a Professional on the platform.
  • b) Require at any time additional information or documentation that accredits the experience, training or suitability of the Professional for the services they offer.
  • c) Reject, limit or cancel those profiles, services or economic proposals that, in the reasonable judgment of LETRARIA, constitute a systematic undervaluation of professional work, a risk of intrusion or a significant alteration of fair competition conditions among users.

These actions are understood without prejudice to any legal actions that may correspond in defense of the legitimate interests of LETRARIA and the group of Professionals that make up the platform.

4.7. Professional Profile Validation and Feature Activation

In order to ensure that services offered through the platform are provided by duly qualified professionals, access to certain functionalities—in particular, sending proposals to projects and effective service contracting—will be conditional on prior validation of the professional profile by LETRARIA.

Until LETRARIA has verified and approved the user's profile as a Professional, they will not be able to:

  • a) Send proposals or economic offers in response to projects published on the platform.
  • b) Be shown or recommended to the Client as a Professional available for contracting.
  • c) Activate or publish certain professional services that require a specific level of accreditation.

The validation process may include, among other aspects, review of the information provided in the profile, curriculum vitae, professional links, samples of work performed and any other documentation that LETRARIA considers necessary to accredit the professionalism, experience and solvency of the user.

LETRARIA may deny validation or leave it suspended when:

  • a) The information or documentation provided is insufficient, contradictory, inaccurate or does not allow accrediting a minimum of professionalism in the declared service areas.
  • b) There are indications of professional intrusion, lack of qualification or risk of unfair competition practices.
  • c) The user does not respond to reasonable requests for expansion or updating of information within an adequate period.

Likewise, LETRARIA may revoke the validation of a professional profile or place it again in pending review status if, subsequently, it detects relevant changes, inconsistencies, conduct contrary to these Terms and Conditions or any other circumstance that puts at risk the trust, service quality or user security.

4.8. Star Rating System for Professionals

In order to facilitate the Client's understanding of the level of professionalism of Professionals registered on the platform, LETRARIA may assign each profile an internal rating in the form of stars or other categories visible on the platform.

This rating is based on LETRARIA's own criteria, defined objectively and professionally, which include, among others:

  • a) Knowledge and competencies demonstrated by the Professional in their area of specialization.
  • b) Information contained in their curriculum vitae, professional background and accredited training.
  • c) Quality, coherence and adequacy of services offered within the platform.
  • d) Previous experience accredited through work samples, publications, references or certificates.
  • e) Degree of professionalism shown in the use of the platform, including compliance with deadlines, quality of deliveries and communication maintained with Clients.
  • f) Rating derived from opinions, reviews or scores that, where applicable, may be issued by Clients after project completion.

Star categorization is indicative and does not constitute a guarantee of result, nor an official external certification, but rather an internal tool designed by LETRARIA to grant a category of professionalism based on professional merits, experience and conduct within the platform.

LETRARIA reserves the right to review, update, modify or withdraw at any time the rating assigned to a Professional, especially when new merits, relevant changes in their activity, breaches of these Terms and Conditions, or inaccurate information in their profile are detected.

Any attempt to manipulate this categorization system is prohibited, including the provision of false information, fraudulent generation of reviews or any other practice that, in the reasonable judgment of LETRARIA, alters or attempts to illegitimately alter the assigned rating.

5. Platform Operation (Services Marketplace)

5.1. Project Publication

The contracting process on the LETRARIA platform begins with the creation of a project by the Client, in which they must describe as accurately as possible the required service, including its typology, objectives, execution deadline and other relevant details for its correct valuation.

At this stage, the Client is not obliged to set a prior budget, as it will be the Professionals who propose their fees in the offers they send through the platform.

The Client may choose between the following publication modalities:

  • Public: the project will be visible to all Professionals registered on the platform, who may freely submit their proposals.
  • Private: the project will be accessible only to those Professionals previously selected and invited by the Client.

5.2. Proposals and Selection

Interested Professionals may send their proposals in relation to the published project.

Proposals sent by Professionals will include, at minimum, a description of the work approach, estimated delivery deadline and total price offered for the service provision. The Client will select the proposal they consider most suitable to their interests among those received through the platform.

After selection, LETRARIA will automatically generate a Service Order Contract, which must be expressly accepted by both parties (Client and Professional) through the platform, formalizing the contractual relationship under the agreed terms.

Minimum Client interaction with proposals

In order to maintain an active environment and avoid the accumulation of inactive projects, the Client commits to maintaining a minimum of interaction with received proposals (for example, opening the proposal, sending messages to the Professional, requesting additional information, marking as "under review", acceptance or rejection).

If 7 natural days elapse since the receipt of the first proposal without any interaction from the Client, projects published as "Public" may be automatically reclassified by LETRARIA as "Private", ceasing to be visible to new Professionals.

5.3. Contractual Role and Invoicing

For tax and legal purposes, LETRARIA acts as a technological intermediary that facilitates direct contracting between the Client and the Professional. This structure allows guaranteeing traceability, transparency and legality of each operation.

Contractual and invoicing obligations are structured as follows:

  • The Client contracts directly with the Professional for the service provision.
  • The Professional issues an invoice to the Client for the agreed amount of the service provided.
  • LETRARIA issues an invoice to the Client for the applied intermediation commission.
  • LETRARIA issues an invoice to the Professional for the applied intermediation commission.

Generated documentation:

  • Professional → Client: Invoice for the agreed amount of the service provided.
  • LETRARIA → Client: Invoice for the intermediation commission.
  • LETRARIA → Professional: Invoice for the intermediation commission.

5.4. Secure Payment (Escrow System)

LETRARIA uses a secure payment system through escrow, managed by the Stripe Connect payment gateway. The Client must pay in advance the full amount of the project, understood as the price offered by the Professional and accepted by the Client through the platform, which will be securely retained until the work has been delivered and approved.

Once the Client validates and approves the work performed, the funds are released in favor of the Professional, previously deducting applicable commissions and taxes. This system guarantees security and transparency in the economic flow between the parties.

5.5. Internal Communication

LETRARIA makes available to users a private messaging system within the platform, intended exclusively for communication between Client and Professional regarding ongoing projects.

Users commit to using this channel professionally, respectfully and confidentially, refraining from using it for purposes unrelated to the activity developed within the platform.

LETRARIA reserves the right to supervise such communications in a non-intrusive manner, solely for security purposes, fraud prevention or conflict resolution between users, guaranteeing at all times data protection and respect for privacy.

5.6. Registration via Google Account

Users have the possibility to register on LETRARIA using their Google credentials. In such case, the user expressly authorizes LETRARIA to access certain basic data from their profile (name, surname and email address) necessary for account creation.

Registration through this modality implies full and unreserved acceptance of these Terms and Conditions, as well as the platform's Privacy Policy.

6. Payments, Commissions and Secure Environment

6.1. Applicable Commissions

For the use of the platform and the intermediation provided, LETRARIA will apply a 10% commission to the Client and another 10% to the Professional, calculated on the gross amount of each project managed through the platform.

These commissions allow financing the general operation of LETRARIA's digital ecosystem, including, among others, the following concepts:

  • Platform maintenance and improvement costs.
  • User support and attention services.
  • Operational costs derived from the use of the payment gateway.
  • Development of automated tax tools for invoice issuance and legal documents.

These commissions will be visible and itemized during the project contracting, acceptance and payment process, and will be applied automatically once the operation is completed.

6.2. Payment Management

Payment management is carried out mainly through the Stripe Connect platform, in accordance with applicable European regulations, in particular Directive (EU) 2015/2366 on payment services in the internal market (PSD2), which guarantees high standards of security, consumer protection and traceability.

Stripe acts as an intermediary payment entity, retaining funds in an escrow system until express validation by the Client regarding the correct completion of the contracted service. Once work delivery is approved, funds are automatically released in favor of the Professional, after deducting the corresponding commission.

6.3. Alternative Payment Methods

In those countries or territories where Stripe Connect is not operational, LETRARIA will enable verified alternative payment methods, which must meet equivalent conditions of security, traceability and regulatory compliance.

Among the alternative methods that may be enabled, subject to verification and validation by LETRARIA, are:

  • Payoneer
  • PayPal Business
  • Wise (TransferWise)
  • Certified bank transfers

Any alternative method must:

  • Allow verifiable proof of payment by the Client.
  • Ensure temporary retention of funds under conditions equivalent to the escrow system.
  • Facilitate automated issuance of tax receipts, both for the Client and the Professional.
  • Comply with the principles of traceability, legality and transparency required by applicable legislation on tax matters and fraud prevention.

LETRARIA reserves the right to reject methods that do not meet these standards or that present operational, legal or security risks.

6.4. Minimum Price Policy and Professional Value Protection

In order to protect the value of Professionals' work and avoid unfair competition practices or systematic undervaluation of services, LETRARIA has an internal model for setting minimum price limits.

In particular, LETRARIA reserves the right to:

  • a) Reject or block those economic proposals that are below 30% of the average of offers presented for the same project or, where applicable, below the minimum thresholds that the platform determines based on the type of service.
  • b) Automatically adjust the project budget to the minimum amount allowed by the system when the presented proposal is below said threshold, informing the affected Professional of this circumstance.

Repeated offers that consciously and systematically violate these limits may be considered a serious breach of these Terms and Conditions and result in temporary or permanent suspension of the Professional's account.

7. Intellectual Property

7.1. Original Work Ownership

The Client retains at all times the moral and patrimonial rights over any content, text, idea, manuscript or original document that they contribute to the project commissioned through LETRARIA. Such ownership is not transferred by sharing or incorporating such content on the platform.

7.2. Professional Rights

The Professional does not acquire any intellectual property rights over the Client's work or over the final result of the commission, once the work is completed and delivered. Their intervention is limited to the provision of the commissioned service, without this attributing to them powers of reproduction, distribution, public communication or transformation over the final result.

7.3. Assignment of Rights to Client

Once full payment of the project has been made and correct receipt and approval of the work by the Client has been confirmed, the Professional undertakes to assign to the Client, on a non-exclusive or exclusive basis as agreed, the rights of use, modification, adaptation, reproduction, distribution and publication of the commission result, without territorial or temporal limitation, unless expressly indicated otherwise in the corresponding service order contract.

7.4. "Ghostwriting" Commissions

In ghostwriting or writing on behalf of others commissions, unless otherwise agreed, the assignment of rights will be total, exclusive and without reservation, expressly including the Client's right to publish the work under their own name, without any need for recognition to the Professional as author or co-author of the content.

7.5. Originality Guarantee and Responsibility

The Professional declares and guarantees that the delivered work:

  • Is original and the result of their own creation.
  • Does not infringe copyright, intellectual or industrial property rights of third parties.
  • Has not been copied or reused without authorization.
  • Does not incur in acts of plagiarism, nor in violation of moral or patrimonial rights of others.

The Professional assumes full responsibility in case of claims for infringement of third-party rights, holding LETRARIA and the Client harmless against any legal action, claim or damage derived from such non-compliance.

8. Exclusive Use of the Platform

In order to guarantee transparency, traceability, legal and tax security of relationships between Clients and Professionals, all phases of the contracting process must be carried out entirely through the LETRARIA platform.

Specifically, the following phases are included within the scope of mandatory platform use:

  • Project or commission publication.
  • Presentation and management of proposals by Professionals.
  • Formalization of the service order contract.
  • Payment management and execution.
  • Delivery and approval of final work.

It is strictly prohibited to use the platform as a mere contact channel to establish contractual relationships or payments outside the LETRARIA environment, in order to evade commissions, quality controls, tax obligations or conditions established in these Terms and Conditions.

Any attempt to evade the payment, invoicing or commission systems provided by the platform will be considered a serious breach, which may result in:

  • Immediate suspension of the involved user's account, without prior notice.
  • Permanent expulsion from the platform, with loss of access to any functionality or ongoing project.
  • Legal actions in defense of LETRARIA's legitimate interests, including claim for damages if applicable.

LETRARIA reserves the right to conduct internal audits and behavior analysis within the platform to detect patterns of evasion or misuse, applying disciplinary measures in accordance with what is provided in this document.

9. Cancellations, Revisions and Conflict Resolution

9.1. Cancellations

The Client may request project cancellation depending on the progress status of the commission, in accordance with the following conditions:

  • If work has not yet begun: The Client will be entitled to a refund of the amount paid, after deducting management expenses derived from the use of the payment gateway or other non-recoverable administrative operations.
  • If work is already in progress: LETRARIA will evaluate the degree of progress of the commission, and the Client must pay proportionally the amount corresponding to the work effectively performed and verified up to the cancellation date. The remainder will be refunded, also deducting the corresponding management expenses.

9.2. Revisions

The Client may request reasonable revisions or adjustments within the framework of the contracted commission, provided that the modifications are aligned with the previously accepted terms and conditions.

If the Client requires substantial modifications or scope changes that significantly alter the nature, extent or purpose of the initial commission, it will be necessary to formalize a new project and contract, with their corresponding economic conditions and delivery deadlines.

9.3. Approval and Payment Release

Once the final work has been delivered by the Professional, the Client will have a maximum period of 7 natural days to:

  • Approve the work and authorize payment release.
  • Request revisions under the terms previously stated.

If, after said period, the Client does not issue any response or observation, the system will understand that the work has been tacitly approved, proceeding automatically to release funds to the Professional, in accordance with the escrow system provided.

9.4. Conflict Resolution

In case of disagreement between Client and Professional, the parties commit to try to resolve the conflict amicably, using first the internal dispute resolution system offered by LETRARIA.

LETRARIA will act as a neutral mediator, examining the evidence, communications and deliveries made within the platform, in order to facilitate an equitable agreement between the parties. However:

  • LETRARIA's intervention does not imply assumption of legal or economic responsibility for the substance of the conflict.
  • If the controversy is not resolved through this route, both parties may resort to competent courts, in accordance with the legislation and jurisdiction provided in this document.

10. Limitation of Liability

LETRARIA acts as a technological intermediary between Clients and Professionals, providing a digital platform that facilitates contact, project management, payments, invoicing and necessary support for contracting services in the field of letters, editing and production of related content.

In no case will LETRARIA be considered a direct party to the service provision contract entered into between the Client and the Professional, nor will it assume any responsibility for the result, quality, compliance, authorship or legal effects of work performed by Professionals.

LETRARIA's liability is limited exclusively to the following functions:

  • a) Maintenance and availability of digital infrastructure, including reasonable security measures, data integrity and technical operation.
  • b) Management of payments, commissions, retentions and invoicing derived from operations carried out within the platform, in accordance with the system described in these Terms and Conditions.
  • c) Provision of basic technical and administrative support to the User, in relation to the use of the platform and its functionalities, as well as management of operational incidents.

LETRARIA does not guarantee permanent and uninterrupted availability of the platform, although it commits to adopt all necessary measures to restore service in case of technical interruptions, scheduled maintenance or fortuitous incidents.

Nor will it be responsible for:

  • Improper or fraudulent use of accounts by users.
  • Data loss due to causes external to the system.
  • Non-compliance with tax or legal obligations by users.
  • Indirect damages, lost profits or any harm derived from the direct relationship between Client and Professional.

11. Personal Data Protection

LETRARIA informs users that the processing of personal data is carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free movement of such data (GDPR), as well as Organic Law 3/2018, of December 5, on Personal Data Protection and guarantee of digital rights (LOPDGDD).

Personal data provided by users during the registration, contracting or use of the platform process will be processed for the following legitimate purposes:

  • Manage user registration and access to their profiles.
  • Facilitate service contracting, including project creation, proposal submission and service order formalization.
  • Manage payments, invoicing and tax obligations derived from operations carried out through the platform.
  • Maintain operational security of the platform, prevent fraud and guarantee compliance with these Terms and Conditions.

LETRARIA acts as Data Controller for personal data and adopts appropriate technical and organizational measures to guarantee an adequate level of security to the risk.

Users may exercise at any time their rights of access, rectification, deletion, opposition, limitation of processing and portability, by express request sent to the email address indicated in the Privacy Policy published on the platform, having to prove their identity with a valid document.

12. Duration and Termination

The legal relationship between the user and LETRARIA will have an indefinite duration, and will remain in force while the user's account remains active on the platform.

12.1. Voluntary User Cancellation

The user may request at any time the voluntary cancellation of their account, through the means enabled on the platform or through a request sent to the contact address provided in the Privacy Policy.

Cancellation will be effective once verified:

  • The non-existence of ongoing projects.
  • Complete resolution of any open dispute or incident.
  • Compliance with pending tax, contractual and economic obligations.

12.2. Suspension or Deletion by Letraria

LETRARIA reserves the right to temporarily suspend or permanently delete the account of any user who incurs in:

  • Non-compliance with these Terms and Conditions.
  • Improper or fraudulent use of the platform.
  • Acts contrary to good faith, respect between users or current legality.
  • Evasion of established payment, invoicing or commission systems.

Before definitive closure of an account by LETRARIA, verification will proceed and, where applicable, compliance with all tax, economic or contractual obligations that may be pending by the user will be required.

Account cancellation does not exempt the user from responsibility derived from actions performed previously, nor does it imply automatic deletion of records that must be kept by legal, tax or accounting imperative.

13. Appropriate Use of the Platform

The user commits to use the LETRARIA platform in accordance with current legality, these Terms and Conditions, and the principles of contractual good faith, professionalism and respect towards other users.

In particular, the following is expressly prohibited:

  • Registering false, inaccurate data or data corresponding to third parties without their consent.
  • Disseminating, storing or sharing illicit, offensive, defamatory, discriminatory, threatening content or contrary to public order and morality.
  • Using the platform for purposes other than those expressly provided, that is, contracting professional services in the editorial, literary, linguistic or related fields.
  • Contacting other users with the purpose of evading the contracting, payment or invoicing mechanisms established by LETRARIA, as well as to continue the relationship outside the platform environment.

LETRARIA reserves the right to temporarily suspend or permanently delete the account of any user who incurs in conduct contrary to this clause, without prejudice to civil, criminal or administrative responsibilities that may derive from such acts.

14. Applicable Legislation and Jurisdiction

These Terms and Conditions are entirely governed by Spanish legislation, without prejudice to the application of mandatory rules from other jurisdictions when so required by private international law or consumer regulations.

14.1. Users Residing in Spain

For the resolution of any controversy derived from the use of the LETRARIA platform or the interpretation, application or compliance with these Terms and Conditions, the parties expressly submit to the jurisdiction of the Courts and Tribunals of Santander (Cantabria, Spain), waiving any other jurisdiction that might correspond to them.

14.2. Users Residing Outside Spain

In the case of users domiciled outside Spanish territory, and unless the mandatory legislation of the country of residence provides otherwise, any conflict will be submitted to the jurisdiction of the Courts and Tribunals of Santander (Cantabria, Spain).

15. Modifications

LETRARIA reserves the right to modify, update or adapt at any time these Terms and Conditions, for legal, technical, operational reasons or in order to improve the quality and functionality of services provided through the platform.

Any modification will be duly notified to the user, either:

  • Through a visible notice on the platform itself.
  • Or through direct communication by email to the address provided in the user's profile.

Continued use of the platform after the entry into force of the modifications will imply express and unreserved acceptance of the new terms.

In case of disagreement with the introduced changes, the user may request cancellation of their account without any penalty, without prejudice to the obligation to comply with pending contractual, tax or economic responsibilities until the cancellation date.
